Win Greg’s Car Sweepstakes

A Purchase OR ACTIVITY COMPLETION WILL NOT INCREASE YOUR Chances Of Winning. Open only to legal residents of Canada (excluding residents of Quebec) and the fifty (50) United Sates and the District of Columbia, 13 years of age or older (except residents of Maine, who must be 18 years of age or older). Eligible minors should obtain the permission of their parents or legal guardians prior to participating in this sweepstakes.  Void in Quebec and where prohibited.  Employees (and their immediate families (parent, child, spouse or sibling and their respective spouses, regardless of where they reside) and those living in their same households, whether or not related) of Greg Sczebel Music (“Sponsor”), and its parent, affiliates, subsidiaries and advertising and promotion agencies are not eligible to enter or win.  By participating, entrants (and, if eligible minors, their parents or legal guardians) agree to be bound by these Official Rules and the decisions of the judges and/or Sponsor, which are binding and final on matters relating to this sweepstakes.  Sweepstakes is subject to all applicable federal, state, provincial and local laws.

to enter: Between 9:00 p.m. Eastern Time (“ET”) on September 6, 2009 and 11:59 p.m. ET on September 6, 2010 (the “Entry Period”), there are two (2) ways to enter: 1.) Participate in an Activity: visit www.WinGregsCar.com or www.gregsczebel.com and follow the directions provided to participate in one of the listed activities (each, an “Activity”). Instructions on how to complete each Activity will be provided on the website and are incorporated herein by reference. Each Activity will earn you a specific number of ballots, as outlined on the website. One (1) ballot will be equal to one (1) entry into the sweepstakes. You will be required to photograph (or take a screen capture or provide a live online link) of the realization of each Activity as proof of completion and email it to: contest@gregsczebel.com. All photos must adhere to the photo guidelines below. All proof of completion for Activities must be received by 11:59 p.m. ET on September 6, 2010 to be eligible. Activities may vary from month to month, and are subject to change, at Sponsor’s sole discretion. For a list of Activities, see the chart below. Monthly Activities may only be completed during the month on which they are posted on the website (unless specified otherwise) and must be submitted by 11:59 PM ET on the last day of the applicable month. For the purpose of these rules, a month shall be defined as the time period between 12:01 AM ET on the first day of the month and 11:59 PM ET on the last day of the month. 2.) Mail-in: On a 3" x 5" piece of paper, hand-print your name, complete address, daytime and evening telephone numbers (area code included), and date-of-birth, and mail entry in a properly stamped #10 envelope to: Win Greg’s Car Sweepstakes, Greg Sczebel Music, PO Box 10002, Salmon Arm, BC V1E 3B9, Canada. One (1) mail-in will be equal to ten (10) entries. Entries must be postmarked by September 6, 2010 and received by September 13, 2009 to be eligible.  Limit twenty five (25) entries per person, per email address and per household for the duration of the Entry Period, regardless of method of entry.  Entries received from any person or e-mail address or household in excess of the stated limitation will be void. All mail-in entries must be mailed in separately.  Entries generated by script, macro or other automated or mechanical means and entries by any means which subvert the entry process or that are otherwise not in compliance with these Official Rules are void.  All entries become the property of Sponsor and will not be acknowledged or returned.

Photo Proof Guidelines: Photo must be submitted in jpeg format and cannot exceed 3 mb in size. Photo may only be of entrant and Activity completion. Any photo that is obscene or offensive; contains trademarks or logos owned by others (except Sponsor marks); communicates messages or images inconsistent with the positive images and/or good will to which Sponsor wishes to associate; and/or violates any law will be removed and may render ballots and/or entries null and void.

REQUIREMENTS OF ENTRIES:
All videos must comply with YouTube and/or Facebook size and format requirements and be no longer than 5 minutes in length. Each video you submit must be substantially different from any other video you submit. Videos may not contain, as determined by the Sponsor, in its sole discretion, any content that:

  • is sexually explicit or suggestive; unnecessarily violent or derogatory of any ethnic, racial, gender, religious, professional or age group; profane or pornographic; contains nudity;
  • promotes alcohol, illegal drugs, tobacco, firearms/weapons (or the use of any of the foregoing); promotes any activities that may appear unsafe or dangerous; promotes any particular political agenda or message;
  • is obscene or offensive; endorses any form of hate or hate group;
  • appears to duplicate any other submitted videos;  
  • defames, misrepresents or contains disparaging remarks about other people or companies;
  • contains trademarks, logos, or trade dress (such as distinctive packaging or building exteriors/interiors) owned by others, without permission;
  • contains any personal identification, such as license plate numbers, personal names, e-mail addresses or street addresses;
  • contains copyrighted materials owned by others (including photographs, sculptures, paintings, and other works of art or images published on or in websites, television, movies or other media), without permission;
  • contains materials embodying the names, likenesses, voices, or other indicia identifying any person, including, without limitation, celebrities and/or other public or private figures, living or dead, without permission;
  • contains look-alikes of celebrities or other public or private figures, living or dead;
  • communicates messages or images inconsistent with the positive images and/or good will to which we wish to associate; and/or
  • violates any law.

Video must be the original work of the entrant, may not have been previously published, may not have won previous awards, and must not infringe upon the copyrights, trademarks, rights of privacy, publicity or other intellectual property or other rights of any person or entity (except Sponsor marks).  If the video contains any material or elements that are not owned by the entrant, and/or which are subject to the rights of third parties (except Sponsor marks), the entrant is responsible for obtaining, prior to submission of the video, any and all releases and consents necessary to permit the use and exhibition of the video by Sponsor in the manner set forth in these Official Rules, including, without limitation, name and likeness permissions from any person who appears in or is identifiable in the video. If any individual who appears in the video is under legal age of majority in his/her jurisdiction of residence, entrant must obtain written permission from such individual’s parent or legal guardian. Sponsor reserves the right to request proof of these permissions in a form acceptable to Sponsor from any entrant at any time. Failure to provide such proof may, if requested, render ballots and/or entries null and void and video will be removed from the applicable website.  By submitting a video, entrant (and, if an eligible minor, his/her parent or legal guardian) warrants and represents that he/she and any persons appearing or who are identifiable in the video consent to the submission and use of the video in the sweepstakes and to its use as otherwise set forth herein.

By submitting a video, entrant (and, if an eligible minor, his/her parent or legal guardian) hereby grants permission for the video to be posted on YouTube.com, Facebook.com or other websites. Entrant (and, if an eligible minor, his/her parent or legal guardian) agrees that Released Parties (as defined below) are not responsible for any unauthorized use of Entries by third parties. Released Parties do not guarantee the posting of any Entry.

Sponsor grants to entrant a limited revocable, non-sub licensable, license to use Greg’s music, name, likeness and/or voice (“Assets”) for the sole purpose of completing the Activities listed above (“Entry Materials”) and entrant may make no further use whatsoever of Assets and/or the Entry Materials for any purpose whatsoever. In addition, entrant recognizes all of the right, title, and interest in the Assets, as well as all derivative works created using such Assets (including the Entry Materials) shall vest exclusively in Sponsor, and entrant will not have or take any action that might harm or adversely affect such rights. No right, title, or interest in and to the Assets except for the limited license granted to entrant in these Official Rules is transferred or created.

Drawing:  Potential winner will be selected in a random drawing held on or about September 13, 2010 from all eligible entries received.  Odds of winning depend on the number of eligible entries received.

WINNER NOTIFICATION: Potential winner (and, if an eligible minor, his/her parent or legal guardian) will be notified by mail, phone, and/or e-mail and may be required to execute and return an affidavit of eligibility (or, if winner is a resident of Canada, a declaration), a liability release and, where lawful, a publicity release within 10 days of date of issuance. If such documents are not returned within the specified time period, the prize notification is returned as undeliverable, Sponsor is unable to contact the potential winner or the potential winner is not in compliance with these Official Rules, prize will be forfeited and, at Sponsor’s discretion, an alternate winner selected.  If the potential winner is an eligible minor in his/her jurisdiction of residence, prize may be awarded in the name of his/her parent or legal guardian who will be responsible for fulfilling all requirements imposed on winner set forth herein. If a Canadian resident is selected as the potential winner, he/she (or, if an eligible minor, his/her parent or legal guardian) must correctly answer a time-limited mathematical skill-testing question without assistance or mechanical or electronic aid in order to receive the prize. If the selected Canadian potential winner cannot be reached within 10 days of first attempt to administer skill-testing question, he/she may be disqualified, and, at Sponsor’s sole discretion, the prize will be awarded to an alternate winner.

Prize: Greg's 2009 Nissan cube and a private concert by Greg Sczebel for up to 20 people. Exact date of concert will be determined by Sponsor in its sole discretion. Manufacturer’s Suggested Retail Price (“MSRP”) of Nissan cube: $16,998 Canadian dollars. WINNER WILL BE REQUIRED TO EITHER ARRANGE FOR DELIVERY OF THE VEHICLE OR PICK-UP VEHICLE FROM SPONSOR AT A DESIGNATED LOCATION.  Winner will be required to present a valid driver’s license and proof of appropriate insurance as a condition of receiving prize. Winner and guest(s) must comply with all private concert rules and regulations. Failure to do so may result in forfeiture of all or part of the prize. Total Approximate Retail Value (“ARV”) is $20,000 Canadian dollars. In the event Sponsor is unable to provide Greg’s 2009 Nissan cube for any reason, including if the vehicle is involved in an accident, no compensation or substitution will be provided in lieu thereof; however, remainder of prize package will be awarded and Sponsor will have no further obligation to winner. Winner (and, if an eligible minor, his/her parent or legal guardian) understands that the vehicle is used and prize is awarded “as is” with no warranty or guarantee, either express or implied by Sponsor. Winner may not substitute, assign or transfer prize or redeem prize for cash, but Sponsor reserves the right, at its sole discretion, to substitute prize (or portion thereof) with one of comparable or greater value.  Winner is responsible for all applicable federal, state, provincial and local taxes (including income and withholding taxes) as well as any other costs and expenses associated with prize acceptance and use not specified herein as being provided, including, but not limited to, all title, insurance, license and registration fees and any costs of delivery of vehicle.  All prize details are at Sponsor’s sole discretion.
Winner (and, if an eligible minor, his/her parent or legal guardian) understands that Sponsor may record, photograph and videotape the concert (collectively, “Footage”).  Footage will be owned by Sponsor. Sponsor and its designees shall have the right to use, edit, adapt, post, stream, copy and exploit such Footage and all elements embodied therein, including any names, likenesses and performance embodied therein, in any and all media now known or hereafter devised throughout the world, in perpetuity, for advertising, promotional, trade & other purposes. Any guest(s) attending the concert will be required to execute and return a Footage/publicity release prior to concert and winner (and, if an eligible minor, his/her parent or legal guardian) agrees to assist Sponsor in obtaining such releases from any guest(s).]

OWNERSHIP/USE OF ENTRY MATERIALS:  By submitting any Entry Materials, each entrant (and, if an eligible minor, his/her parent or legal guardian) agrees Sponsor shall own the Entry Materials submitted (including all rights embodied therein) and that it and its designees may exploit, edit, modify, and distribute the Entry Materials and all elements of such Entry Materials, including, without limitation, the names and likenesses of any persons or locations embodied therein, in any and all media now known or hereafter devised, worldwide, in perpetuity without compensation, permission or notification to entrant or any third party.
General Conditions: Released Parties (as defined below) are not responsible for lost, late, incomplete, inaccurate, stolen, misdirected, undelivered, garbled, illegible or damaged ballots, entries, Activity completions or Entry Materials or postage-due mail; or for lost, interrupted or unavailable network, server, Internet Service Provider (ISP), website, or other connections, availability or accessibility or miscommunications or failed computer, satellite, telephone or cable transmissions, lines, or technical failure or jumbled, scrambled, delayed, or misdirected transmissions or computer hardware or software malfunctions, failures or difficulties, or other errors or difficulties of any kind whether human, mechanical, electronic, computer, network, typographical, printing or otherwise relating to or in connection with the sweepstakes, including, without limitation, errors or difficulties which may occur in connection with the administration of the sweepstakes, the processing of entries, ballots, Activity completions or Entry Materials, the announcement of the prize, the cancellation or postponement of the concert, or in any sweepstakes-related materials. Released Parties are also not responsible for any incorrect or inaccurate information, whether caused by site users, tampering, hacking, or by any equipment or programming associated with or utilized in the sweepstakes.  Released Parties are not responsible for injury or damage to participants' or to any other person's computer related to or resulting from participating in this sweepstakes or downloading materials from or use of the website.  Persons who tamper with or abuse any aspect of the sweepstakes or website or who are in violation of these Official Rules, as solely determined by Sponsor, will be disqualified and all associated entries, ballots, and/or Activity completions will be void.  Should any portion of the sweepstakes be, in Sponsor’s sole opinion, compromised by virus, worms, bugs, non-authorized human intervention or other causes which, in the sole opinion of the Sponsor, corrupt or impair the administration, security, fairness or proper play, or submission of entries, ballots, or photo proof, Sponsor reserves the right at its sole discretion to suspend, modify or terminate the sweepstakes and, if terminated, at its discretion, select the potential winner from all eligible, non-suspect entries received prior to action taken or as otherwise deemed fair and appropriate by Sponsor. Entrants (and, if eligible minors, their parents or legal guardians), by participating, agree that Sponsor, and their respective parents, affiliates, subsidiaries and advertising and promotion agencies and all of their respective officers, directors, employees, representatives and agents (collectively, “Released Parties”) will have no liability whatsoever for, and shall be held harmless by entrants against, any liability, for any injuries, losses or damages of any kind, including death, to persons, or property resulting in whole or in part, directly or indirectly, from acceptance, possession, misuse or use of the prize (including any harm/injury caused from the use of the vehicle) or participation in this sweepstakes.  Winner (and, if an eligible minor, his/her parent or legal guardian), by acceptance of prize, except where legally prohibited, grants permission for Sponsor and its designees to use his/her name, address (city and state), photograph, voice and/or other likeness and prize information for advertising, trade and promotional purposes without further compensation, in all media now known or hereafter discovered, worldwide in perpetuity, without notice or review or approval. In the event of a dispute regarding entries received from multiple users having the same e-mail account, the authorized subscriber of the e-mail account at the time of entry will be deemed to be the entrant and must comply with these Official Rules.  Authorized account subscriber is the natural person who is assigned the e-mail address by the Internet Service Provider (ISP), on-line service provider, or other organization responsible for assigning e-mail addresses. CAUTION: ANY ATTEMPT TO DELIBERATELY DAMAGE THE WEBSITE OR UNDERMINE THE LEGITIMATE OPERATION OF THE SWEEPSTAKES IS A VIOLATION OF CRIMINAL AND CIVIL LAWS AND SHOULD SUCH AN ATTEMPT BE MADE, SPONSOR WILL DISQUALIFY ANY SUCH INDIVIDUAL AND RESERVES THE RIGHT TO SEEK DAMAGES (INCLUDING ATTORNEYS’ FEES) AND OTHER REMEDIES FROM ANY SUCH INDIVIDUAL TO THE FULLEST EXTENT PERMITTED BY LAW.
